Equal Protection of Every Living Child in Colorado
Be it Enacted by the People of the State of Colorado:
SECTION 1. In Colorado Revised Statutes, add part 9 to article 6 of title 18 as follows:

Equal Protection of Every Living Child in Colorado
18-6-901. Declaration of the People.
The People of the State of Colorado find and declare that:
The will of the People of the State of Colorado shall uphold the United States constitution according to the Preamble of the United States constitution securing the blessings of liberty to our Posterity.
Every child, regardless of age, developmental ability or disability, health, prognosis, sex/gender, socio-economic background, origin, nationality, or ethnicity deserves to live his or her one life to the fullest extent possible.
The state of Colorado exercises its constitutional and God-given duties to provide equal protection to all individuals within its jurisdiction.
Children shall be protected equally from murder and not discriminated against based on age or level of development.
18-6-902. “Murder of a Child” – Definition as used in this part 9, unless the context otherwise requires:
“Murder of a child” means intentionally causing the death of a living human being at any time prior to, during, or after birth while the child is under the age of 18 years by using or prescribing any instrument, medicine, drug, or any other substance, device, or means, and causing death. This does not include acts with an intent or attempt to:
Save the life or preserve the health of both mother and living child;
Remove a child no longer living; or
Remove or attempt to relocate an ectopic pregnancy.
18-6-903. Murder of a Child Prohibited.
Unlawful conduct. It is unlawful for any person to murder a child.
Penalties. Any person who murders a child will be held to equal penalties of murdering any other child regardless of age, level of development, developmental ability or disability, health, prognosis, sex/gender, socio-economic background, origin, nationality, or ethnicity.
Enforcement. The Attorney General of Colorado shall have concurrent jurisdiction with local law enforcement and district attorneys to investigate, arrest, and prosecute the unlawful conduct created pursuant to section 18-6-903 (1).
18-6-904. Effective date-applicability-self-executing. 18-6-901, 18-6-902, and 18-6-903 shall be self-executing, severable, and take effect January, 1, 2023, if approved by the vote of the people and applies to offenses committed on or after January 1, 2023.
